1. HOW TO USE THIS WEB SITE
This web site is for personal and private use only. Any distribution, modification, transformation, removal, public display, and/or other activity is strictly prohibited, if not expressly authorized by RoomToStay.com
The right to use this webpage, either for looking for information or for making a booking, is reserved to people over the age of 18, to individuals and representatives from companies and/or institutions. RoomToStay.com reserves the right to modify the web-page or parts thereof, as well as its content where deemed necessary.
We always Endeavour to check the veracity of the information displayed on our webpage. Nevertheless, the webpage contains information that depends upon third parties and/or institutions other than RoomToStay.com, and therefore we cannot be held responsible for the veracity and accuracy of said information.
2. BOOKINGS
Booking requests made via the Internet by the user that have been received by RoomToStay.com are contractually binding in nature. Once the contract has been completed they are subject to the General Conditions which per force the user/client must accept in order to complete the contractual process.
RoomToStay.com reserves the right to correct mistakes in calculation or orthography. The client responds to all of the obligations set forth in the contract and moreover will be responsible for any damage and harm that could befall those accompanying or occupying the accommodation.
3. TARIFFS AND PRICES
All tariffs are indicated in Indian Rupees (INR). Changes in exchange rate are updated on a regular basis. Although extremely unlikely, it may occur that prices vary slightly as a consequence of changes in the exchange rate.
RoomToStay.com reserves the right to modify the prices displayed on the web page at any time. These modifications will not under any circumstances affect reservations that have already been contracted. Nevertheless, these changes will be applicable in the case of modifications to bookings that have been requested by clients.
4. REQUESTING SERVICES
Upon making a booking, the user authorizes RoomToStay.com to charge their credit card, or other agreed means of payment, for the amount for each and every booking of services requested via the web page. To effectuate and guarantee a RoomToStay.com booking the user may in certain cases be asked for their bank card details to forward to the accommodation, who in turn must fully observe the legislation for personal data protection. The user expressly authorizes ROOMTOSTAY.COM the right to communicate their bank card details to the necessary accommodation establishment to effectuate and guarantee their booking.
5. CREDIT CARD SECURITY
RoomToStay.com takes every precaution within its means to protect information relating to users. Users’ personal data will be protected both online and offline (in our offices). When the client enters personal data/information (for example their credit card number) onto our forms this information in encoded and protected using the best software on the market.
The user has a commitment to ensure all of the data supplied to RoomToStay.com, either directly through the webpage or by using the customer service system, is complete, correct and precise. The user can only use credit or debit cards of their own possession and never of other people. RoomToStay.com reserves the right to verify data at any time if it is deemed expedient and necessary, with the aim of avoiding fraudulent activity.
RoomToStay.com reserves the right to cancel the booking in the case of monies being returned, the use of stolen cards, false and/or incomplete data or in the case of being unable to verify data supplied by the user.
6. CONFIRMATION OF BOOKINGS
Booking confirmations are automatically generated on screen at the moment of accepting the reservation and are also sent by email subsequent to the booking being made. There is the possibility that this confirmation may arrive to the Spam folder of the user, and therefore the user should, in the instance of not receiving this email, check all of their email folders.
We recommend that this confirmation is printed or saved in a PDF format at the moment that the booking is finalized.
7. CANCELLATION AND AMENDMENT POLICY
Cancellation policy:
Cancellation requests must be communicated via Electronic Mail, fax or the online contact form. CANCELLATIONS WILL NOT BE ACCEPTED BY TELEPHONE.
- In the case of cancellation of a confirmed booking, the prepayment made by the user to confirm the booking will not be refunded, regardless of when the cancellation is made.
- In the case of cancellation 2 days or fewer before arrival or no-show without forewarning: the deposit paid to confirm the booking will be lost. In addition, RoomToStay.com reserves the right to apply a 50% charge upon the outstanding balance.
This cancellation policy will apply on a general basis, except when in the description of the property reserved a different policy is shown, in which case this would take precedence over the general policy
It is recommended, for the above reasons, that you obtain travel insurance which covers you in case of cancellation.
Alteration Policy:
By alterations, the following is understood: changes in the date of services rendered beginning or terminating, number of passengers, the contracted product or changes in the destination.
In order to undertake a change within a booking which involves a reduction in services and/or where a change of accommodation is necessary, firstly cancel the booking which you wish to modify and then carry out a new reservation. By a reduction in services, the confirmation of a cheaper service is understood.
In order to carry out a change in accommodation, it is necessary first of all to cancel the booking that you wish to modify and then make a new booking. Cancellation needs to be made either by a written email or hardcopy to info@roomtostay.com
In the case of a modification which does not involve a reduction of service, nor a change in accommodation, RoomToStay.com will invoice the client for the administration charges upon the stipulated changes as follows:
- 1st Alteration to a booking: Rs 249 as administration charge
- 2nd Alteration and/or successive alterations to a booking: Rs 149 + 10.3% Service Tax in administration/alteration charges for each alteration.
In the case that Open House Spain does not receive the corresponding payment for administration charges prior to the date of commencement of services from the client and/or cancellation charges derived from a change in booking, this omission will authorize RoomToStay.com to cancel, unilaterally and in totality the said reservation for failure to comply with the Terms and Conditions as accepted by the client.
Reimbursement and refunds
In the case that the user is entitled to full or part reimbursement upon the payments made, this will be done in the shortest time possible and without unjustifiable delays. Nevertheless, delays in the payment being made may occur which are out of the control of RoomToStay.com, from Visa/MasterCard or their bank offices. We therefore ask that once a reimbursement has been confirmed to you by us to consult with your bank in the eventuality of possible delays.
8. ARRIVAL/DEPARTURE
In the booking confirmation the place for the handing-over of keys will be indicated, which as a general rule is the same as the address of the accommodation. The client should always get in contact with the contact person before their stay to agree a meeting time and place. As a general rule, this contact person will show the client around the accommodation, bringing the keys and also being present upon the day of departure. The arrival time needs to be agreed with the contact person, and is usually between 4 p.m. and 8 p.m. In the case of delay, the client should inform the contact person immediately.
Departure from the accommodation must be before 11.59 a.m.
In the case of being delayed in arriving at the accommodation, or in the case of an early departure, there will be no discount upon the total price of the booking.
Upon arrival at the accommodation, the client will need to hand over the booking confirmation, as well as a copy of documents confirming their identity (for example passport, Driver’s License, PAN Card, Voter Identity) and all people occupying the accommodation to the contact person for registration. The contact person has the right to refuse people who aren't in possession of identity documentation.
It is not permitted for the accommodation to be occupied by people other than those mentioned in the booking forms or those who are with you upon arrival. Failure to comply with this rule will entitle the proprietor to ask you to leave the accommodation immediately, without any form of compensation or the right to log a complaint.
At the moment of making the booking, the client must advise the number of people who will occupy the accommodation. In the case of exceeding this number, the proprietor has the right to ask you to leave the accommodation immediately, without any form of compensation or the right to log a complaint.
9. DAMAGE DEPOSIT
This deposit is paid as a guarantee to cover for possible damage or imperfections that clients could cause to the building, installations or accommodation. RoomToStay.com neither takes nor refunds this deposit. The existence of a damage deposit is indicated during the reservation process, and must be handed to the accommodation’s contact person, and, following this, the handing back of the damage deposit must be done by the same person. RoomToStay.com has no dealing in and under no circumstances is responsible for the loss of a damage deposit or the possible discussions that could arise from the handing back of a damage deposit. The contact person has the right to refuse to hand the keys over to clients if they refuse to pay the deposit indicated on the booking confirmation. The contact person will hand back the damage deposit on the day of departure, after having carried out an inspection of the state of the accommodation and on the condition that it is found to be in same state as when it was handed over on the day of arrival.
10. BEFORE AND DURING YOUR STAY
ROOMTOSTAY.COM is not responsible for the possible damage or loss that the client may experience during their stay, either within or outside the accommodation, or during their travel to and from the accommodation. It is recommended that travel insurance is obtained for any possible incidence that could arise.
11. DESCRIPTION OF THE ACCOMMODATION
All of the information regarding the accommodation, including photos and prices, is provided by the proprietor to RoomToStay.com and we do everything possible to ensure that this information is correct and to keep it updated. Nevertheless, RoomToStay.com does not take responsibility for the content in the descriptions of accommodation.
12. PRIVACY POLICY
RoomToStay.com wishes to demonstrate its determination in protecting your privacy. If you wish to find out more about the gathering and use of personal data, from whom and how it is obtained and with whom it will be shared, please consult our privacy policy.
RoomToStay.com does not register the user automatically to receive newsletters. The user is able to select whether or not they wish to receive this. If the user does opt to receive the newsletter, they will receive news, destination information, promotions and offers. The user can at any time revoke their consent to receive the newsletter by using the link found at the bottom of the newsletter or by contacting us about this via email (info@roomtostay.com) or telephone (+914442115375).
13. COMPLAINTS
Any incident relating to the accommodation that should arise during your stay should be IMMEDIATELY communicated to the contact person. Should the contact person fail to adopt the appropriate steps in order to resolve the problem within an appropriate period of time, they should contact RoomToStay.com IMMEDIATELY.
Any claim for compensation will only accepted in written form to RoomToStay.com and within the time period of 15 days, counted from the date of departure to which the complaint, communicated to either the contact person or RoomToStay.com during their stay, refers, as indicated in the previous paragraph. Complaints which are not communicated during the stay will not be dealt with. It is therefore important that any incidence is reported IMMEDIATELY.
Under no circumstances will RoomToStay.com be held responsible for possible cuts in the water, light or gas supply as a consequence of exceptional and emergency circumstances established by the relevant governmental body (for example the Department for the Environment).
14. RESPONSIBILITY
RoomToStay.com acts as agent on behalf of the proprietors for private accommodations.
RoomToStay.com and its employees can never be held responsible for delays, accidents, discrepancies between the information received from proprietors and owners regarding the accommodations and the state of property upon users’ arrival, losses, changes to itinerary or tariffs, damage and injury, etc (to both persons and objects), which could occur during one of the contracted services.
Users and those accompanying them expressly declare that they will use the rented apartment in the correct manner, exempting RoomToStay.com from any responsibility for any damages that said use may cause. Users are responsible for damage caused to the apartment or accommodation, except that which normal use may cause.
RoomToStay.com and its employees will never be held responsible for personal harm or injury incurred in any of the service provided by RoomToStay.com
The service rendered by RoomToStay.com concludes with the preparation and emission of booking documentation. The responsibility of Open House Spain is, in every case, limited to the total quantity of the contracted services.
The client is not freed of the obligation of payment due to personal circumstances or force majeure such as war, strikes or natural catastrophes.
15. CANCELLATION OF CONTRACT IN THE CASE OF NON-FULFILLMENT
If the client causes continual disturbances during their stay or behaves in a manner contrary to those established within these general conditions, RoomToStay.com and the proprietor will have the right to cancel the contract unilaterally, the client being obliged in these cases to pay the total amount of the contracted accommodation.
16. PARCIAL NULLITY AND JURISDICTION
In the case of one of the clauses within this agreement being declared null and void, invalid or inefficient, the validity of other paragraphs would not be affected, they would continue being binding.
The outcome of any matter in issue derived from the interpretation and fulfillment of these General Conditions will have to be submitted to judges and courts of the city of Chennai, India with express resignation to any other territorial power or jurisdiction.
17. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The totality of the content which appears on RoomToStay.com website, whether text, images, sound, files, brands, emblems, the combinations of colours, or any other element, its structure and design, the selection and form of presentation of the materials included within, and the computer programs necessary for its operation, access and use, are protected by industrial and intellectual property rights RoomToStay.com and third parties are the owners of this material and have duly authorized its inclusion on the website.
The unauthorized use of the materials and information included on the website could constitute a violation of legislation regarding intellectual or industrial property and other applicable laws.
